Welcome to Design Rush. While browsing this website, you’re agreeing to the terms and conditions as set out below which governs our relationship with you with regards to this website. After reading, if you do not agree with the terms and conditions, we ask you to please not use our site or services.

The terms ‘us’, ‘we’, or ‘Design Rush’ refers to the owners of the website registered at 10 Escombe Court, Godstone Road, Whyteleafe, surrey. The term ‘you’ refers to the users or readers of the site.

The content, products and prices on this website are for your information and use only. They are subject to change and removal without notice.

Your use of any information or materials on the website is entirely at your own risk for which we shall not be liable. It is your responsibility to ensure that products and services meet your own specific requirements.

We do, from time to time include links within our website pages to external services and websites. These links are provided for your convenience, but do not in any way signify that we endorse or recommend said services or websites. We should not be held liable or responsible for the services of these external companies nor the content they provide.

The web sites designed by Design Rush are created based on information provided by each individual web site owner only. The sole and entire responsibility for that same information rests with each individual web site owner and not with Design Rush or any of it’s designers.

Design Rush or Ben Collins will never be held responsible in any way whatsoever for:

• Any damage of any kind (direct, indirect, consequential, incidental or punitive) which results from the use of, access to or inability to use the information contained in any web site which it has designed.
• Any errors or omissions in the contents of any website which it has designed.
• Any damages to or viruses that may infect a site visitor’s computer equipment, software, data or other property which result from a site visitor’s access to, use of or browsing in any site designed by Design Rush.
• Any damages, which result from the downloading of material, data, text, images, video or audio from any site designed by Design Rush.
• Any content in any site linked to a site designed by Design Rush and any resulting damages from a site visitor’s access to any such linked site – site visitors link to any other such sites do so at their own risk.

Should Design Rush work to any directive from a site owner to change the site content then such work is undertaken on the clear understanding that no liability whatsoever relating to such changes is assigned to Design Rush. We do provide a professional service and as such will endeavour to advise web site owners of potential consequences of such changes’ as we believe to be true at the time.

All work instructions must be received by email after payment is complete from the web site owner or their appointed representatives before any such work will be undertaken by Design Rush. This avoids any confusion as all instructions and invoices are kept for future reference.

Ownership of web work completed by Design Rush will only be passed to the web site owner upon written agreement of the works completion and until then will remain the property of Design Rush.

Design Rush do not make any warranties of any kind, expressed or implied for the services it provides. Design Rush disclaims any warranty or merchantability or fitness for a particular purpose.

Without limiting the foregoing, Design Rush shall not be liable for loss of data resulting from delays, non-delivery, wrong delivery, or any and all service interruptions caused directly or indirectly by Design Rush.

Design Rush shall not be liable to any business for any incidental, consequential, special, or punitive damages or lost or imputed profits or royalties arising out of this agreement or any goods or services provided, whether liability is asserted in contract (including negligence and strict product liability) and irrespective of whether advice has been given of the possibility of any such loss or damage.

Design Rush reserves the right to revise its terms, conditions and charges at any time and without prior notice. It is your responsibility to stay up to date with these terms and conditions before and during undertaken work.

After payment for work is made, any products or services with applicable deposits shall be non refundable. We shall make non refundable products and services known via the ‘additional information’ section on each product page. We reserve the right to decline requests for work and any payment taken will therefore be refunded in full.

The provisions set above allocate the risks under this agreement between the parties and it is agreed that such allocation and limitation are not unenforceable.

In the unlikely event of a dispute which can not be resolved amicably then it is deemed that the law of England, Wales, Scotland and Northern Ireland will be imposed to resolve any legal situations.
